Terms of Service
These terms are an agreement between you and WarpX. Please read them carefully: by creating an account, installing the App or otherwise using the Services, you agree to them.
These Terms of Service (“Terms”) govern your use of the WarpX desktop application (the “App”), the websites at warpx.app and account.warpx.app, and the licence service and related services (together, the “Services”) provided by WarpX (“WarpX”, “we”, “us”). Our Privacy Policy explains how we handle personal information and forms part of these Terms. If you use the Services on behalf of an organisation, you agree to these Terms for that organisation and confirm you have authority to do so.
1. The Services
WarpX is software for creating and running many separate browser profiles on your own computers, each with its own settings, cookies, proxy and browser fingerprint, and for automating them with workflows. The App runs on your computer and stores your profiles there. Your account at account.warpx.app holds your plan and the list of computers allowed to use it. Optional features, such as connecting your own Google Drive, are described in the App and in our documents.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Services. You may not use the Services if you are barred from doing so under the laws that apply to you, or if we have previously terminated your account for breaking these Terms.
3. Your account and devices
- You must give accurate information when you create an account, including an email address you can access, and keep it up to date.
- You are responsible for keeping your password and your linked computers secure, and for all activity under your account. Tell us promptly at [email protected] if you suspect unauthorised access.
- An account is for one person or organisation. You may not sell, transfer or share your account, or let others link devices to it, beyond what your plan allows.
- You can sign out a linked device from the website at any time, which frees its place for another computer.
4. Plans and limits
The Services are offered as a Free plan and paid plans. Each plan sets limits, such as the number of profiles, linked devices and browsers open at the same time; current plans and prices are shown in the Pricing section of our website and in your account. The App checks your plan with our licence service and applies its limits. When a paid period ends and you have not bought another, your account returns to the Free plan's limits. Your profiles remain on your computer, but you may not be able to open or create profiles beyond those limits until you upgrade. You may not attempt to bypass plan limits or the licence checks.
5. Payments
- Currency and network. Paid plans are paid in USDT on the TRON network (TRC-20) or on BNB Smart Chain (BEP-20), as chosen at checkout, to the deposit address shown on the invoice created for your purchase. Tokens sent on any network other than the invoice's, in any other token, or to any other address cannot be credited and may be lost permanently. We are not responsible for such losses.
- Quote and amount. Each invoice shows an exact amount and is valid for a limited time (currently 60 minutes). Send the full amount before the invoice expires. If you send less, the invoice stays unpaid until the difference arrives at the same address before it expires. You are responsible for network fees.
- Activation. Your plan is activated once your transfer has been confirmed on the blockchain, which usually takes a few minutes.
- Prepaid, no automatic renewal. Every purchase is a prepaid period (for example 30, 90 or 365 days) or, where offered, a lifetime licence, which lasts for as long as WarpX provides the Services. Nothing is charged automatically. Buying the same plan again while it is active adds the new period to the time remaining.
- Price changes. We may change prices for future purchases. A change does not affect a period you have already paid for.
- Taxes. Prices do not include any taxes or charges you may owe under the laws that apply to you; you are responsible for them.
- Compliance. You confirm that the funds you use are lawfully yours, and that your payment complies with the laws that apply to you.
6. Refunds
Because blockchain payments cannot be reversed and every period is prepaid, payments are non-refundable except as set out here or where the law requires otherwise. Please try the Free plan before buying. We will, on request, review and refund in USDT to a TRON or BNB Smart Chain address you control, or credit to your account, where:
- you paid the same invoice twice, or sent more than the invoice amount;
- a payment was received but, because of a fault on our side, your plan could not be activated and we were unable to fix it; or
- the paid Services were substantially unavailable for a significant part of your paid period because of a fault on our side.
Send refund requests to [email protected] within 14 days of the payment or the problem, with the invoice's amount, date and transaction. Network fees are not refunded. We do not refund accounts terminated for breaking these Terms.
7. Licence to use the App
Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on the computers linked to your account. You may not, and may not help anyone else to:
- copy, modify, distribute, sell, rent, lease or sublicense the App or the Services, or offer them to others as a service;
- reverse engineer, decompile or disassemble the App, except to the extent the law allows despite this restriction;
- remove, bypass or interfere with licence checks, plan limits, device linking or any security feature;
- access our servers other than through the App and websites, or overload them;
- remove any copyright, trademark or other notices.
The App includes third-party and open-source components, which are licensed under their own terms. Those terms apply to those components.
8. Acceptable use
Tools that manage many browser identities have legitimate uses, such as managing several business or client accounts, advertising and e-commerce operations, testing, research and protecting privacy. They can also be misused. You are solely responsible for how you use the Services and for complying with all laws and with the terms of every website and platform you access. You must not use the Services to:
- break any law or regulation, or infringe anyone's rights;
- commit or facilitate fraud, including payment or card fraud, advertising or click fraud, affiliate or bonus fraud, fake reviews, or scams and phishing;
- access accounts, systems or data without authorisation, including account takeover, credential stuffing or using stolen credentials, cookies or identities;
- impersonate any person or organisation, or create accounts in another person's identity without their permission;
- send spam, run harassment or coordinated inauthentic behaviour campaigns, spread malware, or manipulate elections or public discourse;
- evade sanctions, anti-money-laundering controls, identity verification required by law, or bans imposed on you by law enforcement;
- launch denial-of-service attacks, or scrape or automate websites in a way that is unlawful or damages them;
- distribute or access content that exploits children, or other illegal content;
- infringe intellectual property, including selling counterfeit goods.
We may investigate suspected violations and cooperate with law enforcement where the law requires. Because your profiles and browsing stay on your computer, we do not monitor what you do with them; that also means the responsibility for it is yours.
9. Your data
You own the data you create or store with the App, such as profiles, cookies, workflows and backups. We do not claim any rights to it. Because this data is stored on your computer (and, if you choose, in your own Google Drive), you are responsible for backing it up and keeping it secure. We cannot recover data lost from your computer. You are responsible for having the right to use any credentials, cookies, proxies and other data you put into the App. Our handling of personal information is described in our Privacy Policy.
10. Third-party services, including Google
The Services let you use things we do not control, such as proxies, websites, browser extensions, blockchain networks and wallets, and Google Drive. Your use of them is governed by their own terms and privacy policies, and we are not responsible for their availability, content or actions.
If you connect Google Drive, you authorise the App to create and manage a “WarpX” folder and the files the App creates in your Drive, as described in our Privacy Policy. The connection is made from your computer, and you can disconnect it in the App or from your Google Account at any time. Your use of Google services is subject to Google's Terms of Service. Google is not a party to these Terms and does not endorse WarpX.
11. Our intellectual property
The Services, including the App, websites, software, design, documentation and the WarpX name and logo, belong to WarpX and its licensors and are protected by law. These Terms do not give you any rights to them except the limited licence in section 7. If you send us feedback or suggestions, we may use them freely without any obligation to you.
12. Changes and availability
We improve the Services continually and may add, change or remove features. Some features may be marked as preview or beta; they are provided as they are and may change or stop. We aim to keep the Services available but do not promise uninterrupted operation: maintenance, updates, failures and events outside our control may make them unavailable. The App keeps running your profiles for a period while it cannot reach our licence service, but some functions require a connection.
13. Suspension and termination
You may stop using the Services at any time, and ask us to delete your account by emailing [email protected]. We may suspend or terminate your account, revoke licences or sign out devices, with or without notice, if you break these Terms, if we must do so by law, if your use creates a risk or possible legal exposure for us or others, or if you do not pay. Where reasonable, we will tell you why and give you a chance to fix the problem. Sections that by their nature should survive termination, including 6, 9, 11 and 14 to 19, will survive.
14. Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation. In particular, we do not guarantee that any profile, fingerprint or proxy will avoid detection, blocking, verification requests or account restrictions by any website or platform, or that any automation will achieve a particular result. Websites change their detection methods, and outcomes depend on many things outside our control.
15. Limitation of liability
To the fullest extent permitted by law, WarpX will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill, or accounts on third-party platforms, arising out of or relating to the Services or these Terms, even if we were told such damages were possible. Our total liability for all claims relating to the Services or these Terms is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or USD 50. Nothing in these Terms limits liability that cannot be limited under applicable law.
16. Indemnity
You agree to defend, indemnify and hold harmless WarpX and its people from any claims, damages, losses and expenses, including reasonable legal fees, arising from your use of the Services, your data, your breach of these Terms, or your violation of any law or the rights of any third party.
17. Governing law and disputes
These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to conflict-of-law rules. Before starting any formal proceedings, please contact us at [email protected] so we can try to resolve the dispute informally; both parties agree to try in good faith for at least 30 days. Any dispute that is not resolved this way will be settled by the competent courts of Vietnam. If you are a consumer, this does not take away any protection you have under the mandatory laws of the country where you live.
18. Changes to these Terms
We may update these Terms from time to time. We will change the “Last updated” date above and, for material changes, notify you by email or in the App at least 14 days before they take effect, unless a change is needed sooner for legal or security reasons. If you keep using the Services after the changes take effect, you accept the updated Terms; if you do not agree, stop using the Services.
19. General
These Terms and the Privacy Policy are the entire agreement between you and WarpX about the Services. If any part is found unenforceable, the rest remains in effect. Our failure to enforce any part is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control. If these Terms are translated, the English version prevails.
